Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.

Gurus please help since my case is somewhat unique
I have future GC filed from Company X, the priority date is February 2006.
I am currently working for Company Y on H1B. This H1B will expire in April 2009. Company Y is also ready to file my GC and I would like to work with Company Y till by future GC is approved, my question is
If I have already filed for 485, EAD and AP through Company X, scenario will it be advisable to file another labour and I-140 through Company Y now?
What could be the implications?

as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

July/Aug-07 filer for I-485 at NSC. Applied for EAD Feb-end and Received EAD in the mail last week. Noticed that the validity start date is 3/24/2007 and end date is 3/23/2009

Hello,
In my LCA(H1B) Prevailing wage is $ 55K & in my Labor(PERM) application Prevailing wage is $ 65K.
My labor(PERM) has been approved & I-140 is in process at TSC.
My question is
This diffrence between LCA mentioned prevailing wage(i.e. $55K) & Labor(PERM) prevailing wage(i.e. $65K) going to create any problem at stage of I-140 or later in I-485??
I am getting paid as mentioned in LCA i.e. $55K.
I will greatly appreciate response.

My lawyer submitted the ETA 9089 on Dec. 2007 , we've been checking the case # A-XXXXX-XXXXX and the only thing that shows is: PROCESSING...
Isnt supposed to be 30 days??
My situation is really bad because right now my driver license expired and I cant renew without an Immigration Case Number, but my process stil on DOL as "processing"
Any suggestion or Comments??

I am tired of this GC process like u all are. the following is my situation.
Currently on H1B and 140 cleared with company B, no 485 applied missed the boat during the VISA bulletin fiasco(USCIS money making scam)
i have a future GC with COMPANY A, 485 applied, i have EAD/AP also.
i am tired of my current job, too much exploitation, i want to change, so my question is can i just take some other permanent employment using this EAD/AP
My question is as this future GC with COMPANY A and i have never worked for this company A. can i do a AC21 and move on ?
does AC21 apply future GC. ?
Appreciate any thoughts in this matter

I have taken a 2 day stop over in Dubai while coming back to USA in April 2010. I booked my flight on Emirates. Emirates will sponsor my visa. But i am not sure now they allow Advance Parole as when i apply for visa one of the requirements says "Travel documents, such as re-entry permits and refugee documents are not permitted"

Dear Sir/Madam,
I am in virginia on H1 status and my husband got H4 stamping in India recently.And now i am willing to transfer my H1 from XXX employer to YYY employer.
did my husband can enter the USA with that same H4 stamp after my H1 trasnfer also or not? or does he required to to take new H4 stamp with new employer name of prinicpal applicant before coming to USA.
Is there any Port of entry problem for him in case if he travel on H4 visa showing the Old employer of Principal aplicant.
Kindly give me the reply ASAP.

My wife's H4 was recently approved along with my H1. We both have different last names. My name is misspelled, an "a" missing and her middle initial is also different. What can I do to get a corrected H4? Can I go to local immigration office or something? My lawyer contacted the USCIS and they said they will respond in 45 days. They don't even guarantee that they will correct the approval document.

It seems quite a few individuals with older priority dates from 2003 & 2004 are still waiting for a decision on their RiR cases (both state and regional) from Dallas BEC. It has been recently reported that many of these cases have received RFE's from BEC on a variety of issues (they might also have had an RFE at state or regional). I think it would be advantageous for all of us in similar situation if we can anonymously post the type of RFE's we receive and possible ramifactions for the same.
If some one knows of a similar thread elsewhere please provide a link, that way we can avoid duplicates.
